Terms of Service

These Terms of Service ("Terms") are an agreement between you and [Legal company name] ("Sofoteros", "we", "us") and govern your use of the Sofoteros website builder, the admin application at admin.sofoteros.com, and the hosting of websites you publish with it (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you use the Service for a business or organization, you agree on its behalf and confirm you have authority to do so.

1. The Service and the beta

Sofoteros lets you create a website from our templates, edit its content, invite team members, and publish it on a Sofoteros address or your own domain. The Service is currently offered free of charge as a beta. Features may change, and the Service may be interrupted. We will give reasonable notice before introducing fees, and fees will only apply if you agree to them.

2. Your account and sign-in

  • You sign in with single-use links sent to your email address. Keep access to your email account secure; anyone who can read it can sign in as you.
  • You must provide an email address you control and accurate information about your business or organization.
  • You must be at least 18 years old, or the age of majority where you live, to create an account.
  • Site owners can invite team members. Owners are responsible for who they invite and for their team's use of the Service, and can remove access at any time.

3. Your content

You keep ownership of the text, images, and other material you add ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, and distribute Your Content only as needed to provide, secure, and improve the Service, including publishing your website to the public when you deploy it. You are responsible for Your Content and confirm you have the rights needed to publish it.

4. Acceptable use

You may not use the Service to:

  • publish anything illegal, fraudulent, defamatory, harassing, hateful, or sexually explicit;
  • impersonate another person or organization, or run phishing, scams, or deceptive schemes;
  • distribute malware, collect other people's credentials, or attempt to gain unauthorized access to any system;
  • infringe anyone's intellectual property, privacy, or other rights;
  • send spam, or overload, probe, or interfere with the Service or other customers' sites.

We may remove content or suspend sites that we reasonably believe break these rules, and where practical we will tell you why. Report abuse to [legal@sofoteros.com].

5. Domains

If you connect your own domain, you must own or be authorized to use it, and you remain responsible for your registration and DNS settings. We may decline or disconnect domains that we cannot verify or that are used in breach of these Terms.

6. Our intellectual property

The Service, including our templates, software, and branding, belongs to us and our licensors. You may use the templates only to build and operate websites through the Service.

7. Availability and changes

We work to keep the Service available and secure, but during the beta we do not guarantee any particular uptime. We keep revisions of your saved content, but you are responsible for keeping your own copies of important material.

8. Ending your use

You can stop using the Service at any time and ask us to delete your account by emailing [legal@sofoteros.com]. We may suspend or end your access if you seriously or repeatedly breach these Terms, if required by law, or if we discontinue the Service, in which case we will try to give you notice and a chance to export your content.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or 100 US dollars. Some jurisdictions do not allow these limits, so they may not apply to you.

11. Indemnity

You will defend and indemnify us against claims arising from Your Content or your breach of these Terms, to the extent permitted by law.

12. Changes to these Terms

We may update these Terms. When we make a material change we will update the version above, and you will be asked to accept the new version before continuing to use the Service.

13. Governing law

These Terms are governed by the laws of [State/country whose law governs these terms], without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
